During my senior year, my folks let me know that my college fund should cover my tuition, books, and living expenses for at least the first two years of college. The specific college and my course of study would determine how far my funds would stretch. Cathy's parents would pay for her education since her family was very well off financially. Neither Cathy nor I found out until later that Frank and Mary had plans to assist me financially, if it became necessary.
Cathy and I discussed our futures before we graduated from high school. We decided we would continue to live with our families until we started college. When we started college, we would live together in the married student quarters. Our local college was actually highly ranked in our state, so it's not as if we were attending a second rate institution just so we could be together. Cathy planned to study financial investment and management, and I wanted a computer science degree.
Cathy and I talked with our parents about our plans for the summer and college. Frank and Mary were a little disappointed that Cathy wasn't interested in a more prestigious college and suggested several to her. Cathy told her parents that she had researched those colleges and our local college. She believed that the rankings of the colleges her parents suggested were declining, while our local college's ranking was climbing. She projected that our local college's ranking would be as high as that of the colleges her parents suggested by the time we obtained our degrees. They dropped their objections to the local college and gave her their full support.
As far as summer jobs went, our parents gave us their full support. Frank offered Cathy a summer internship at his company. It would provide her with practical experience in financial investment and management. My dad said his company often provided internships to the college-aged children of their employees. He would help me look into obtaining a position. Mary said if that didn't work out for me to let her know. She would be willing to take me on in her business and teach me about the web design business.
That summer Cathy and I were very busy with our summer internships. My dad's company took me on in their IT Department. Most of my work was to aid the IT techs in the support of the company's intranet, peripherals, and employee computers. I learned a lot about computers and computer networks that summer. The experience helped me during several of my college courses. The company said they would work with me in setting my work schedule. I must have done a good job for them for at the end of the summer, they offered me a part-time internship during the school year. Cathy also found her experience in her father's firm to be rewarding in practical experience. Frank kept her on in a part-time position once the summer break ended.
Our mothers were busy that summer for they hosted an engagement party for us a month after we announced our engagement. It wasn't a large affair, since Frank and Mary had no relations who would attend. I learned that they had a few relatives, but they were not on speaking terms with them due to the way their relatives treated them when they announced their engagement. The guest list Cathy and I put together included our immediate family, my close relatives, our friends, and a number of our parents' close friends.
The engagement party was held at one of our local restaurants and was probably typical of most engagement parties. Cathy and I enjoyed ourselves, and our parents even slipped us several glasses of wine. The adults had a few glasses of wine or beer with their meals and became slightly tipsy, but I don't think any of the adults left drunk.
Our parents weren't sure of how it happened, but a couple of our friends were slightly inebriated and one was very drunk. Our parents didn't give our drunken friend a choice; they took his keys away. They gave our slightly inebriated friends the choice of surrender their car keys or have their parents notified of their conditions. They surrendered their keys, and our parents saw that they got home safely. Cathy found out the next day that they brought several bottles of wine and whiskey with them and would go to their cars for a drink when they said they were going to the restroom.
Summer eventually ended, and we started our first year of college. College was a big change from high school, and our first weeks were hectic. The arrangements we made for student housing started falling apart a week before we started classes.
The college's policy allowed unmarried couples to live together in married student housing. The department had a new manager who believed it was immoral for unmarried couples to cohabit. The new manager refused to honor our approved application for housing. Cathy and I filed a protest with the college. Our parents had a few contacts in the college administration who they spoke to regarding this manager's decision. Two days after we filed our protest, we received notification that a one-bedroom apartment was available for us. The word on the student grapevine was that the Chancellor spoke to the Student-Housing Manager about college policy versus personal policy. In retaliation, the manager selected the most rundown apartment in the complex just for us.
The apartment may not have been the worst in the complex, but it was in bad shape. We didn't care for we would be together. A little bit of work and money would make the apartment livable. We took extensive photos of the apartment to document its condition at the time we accepted it. Our families and new neighbors helped us to paint and clean it up. We also took photos of the place after we cleaned it up, but before we moved in our belongings. We finished moving in and getting organized before classes started.
The first six weeks of class went well for both of us. We joined a group of married students that aided each other with the myriad problems that came up in the day-to-day campus life of married couples, especially those with children.
The first indication that we had a big problem was when the Student-Housing Department sent an inspector to our apartment. The inspector made a rather long list of the defects that he found in our apartment and said that we would be hearing about the repair of these defects. The following week we received a letter requesting we attend a meeting at the Student-Housing Department regarding our apartment.
We arrived early, and the Department Secretary asked us to be seated until the Department Manager, Miss Johnson, could see us. She then let Miss Johnson know we were there.
About five minutes later, a gentleman came out of her office. The secretary told us that we could go in now.
As we entered the office, Miss Johnson motioned to the chairs in front of her desk and said, "Please take a seat. I am Miss Amelia Johnson, and I assume that you are Mr. Conrad and Miss Ambrose."
"Yes Ma'am", I said.
Miss Johnson said, "I asked the two of you to come here today so we could discuss the damages you have done to the apartment you are leasing."
Cathy and I looked at each other in shock and Cathy said, "What are you talking about? We haven't damaged the apartment."
"Well, I have here an inspection report that itemizes numerous deficiencies in your apartment. The two of you have only been living there for about two months. This amount of damage in eight weeks is excessive."
"Miss Johnson, I'm not sure I know what you mean. The apartment was trashed when we got it. We cleaned it up and did numerous repairs to make it livable. The damage listed on your report was there when we got the apartment."
"Mr. Conrad, this department goes through its apartments and completely reconditions them before we lease them to students. Thus, the damages had to be done after you moved in."
"That's bullshit," Cathy said. That apartment was trashed when we got it. We took photographs to document its condition, and we have the photographs that prove it. We also have witnesses that will confirm it."
"Miss Ambrose, you are lying for we don't lease our apartments in that condition. The college has a policy against students doing repairs, so any work you did was a violation of college policy. You will have to pay for the repairs necessary to restore the apartment to the condition it was in when you received it."
Miss Johnson held out an envelope, and I took it. She said, "This is an eviction notice. The two of you have 48 hours to get out and return the keys to us."
Cathy and I linked with her. We learned that she was a member of a strict religious group and had a major phobia regarding couples cohabiting. She believed we were the devil's spawn, and she was on a mission to get rid of us and to punish us in the process. We could tell from her emotions and thoughts that she was very pleased with herself for setting us up, but she was not focusing on the details of how she set us up.
After we left her office, we called our parents and explained the situation to them. They said they would call their contacts in the college administration. Their contacts couldn't help for the department manager appeared to have the power to evict us for cause, and protesting her eviction notice through the college channels would put us beyond the eviction date.
We went to our student legal center and filed a complaint against the Student-Housing Department. The representative told us that there was no way to get a stay on the eviction notice, and in the past, the college administration had dismissed other complaints without a hearing.
We decided to file a lawsuit against the college. We arranged for a moving company to move our belongings out of the apartment and store them, until we could make other arrangements for housing. Once we were out of the apartment and cleaned it, we once again took extensive photographs to document the condition of the apartment. Mary knew that we intended to continue living together as a couple and immediately offered us the use of their spare bedroom, which was Cathy's old bedroom. At least until we could locate another place to live.
The next day Frank took us to the legal firm that he and Mary used. Frank explained to us the law firm had three lawyers, and it dealt with three specific areas of the law: civil, contractual, and estate law.
When we arrived at the firm's office, Frank said, "Good morning Ann. This is Mr. James Conrad and my daughter Cathy. We are here to meet with Harold."
Ann showed us into the office of Harold Smythe a short while later. Frank introduced us to Harold. I told him to call me Jim, and he said we should call him Harold. We explained our situation to Harold and that we wanted to initiate a lawsuit against the college. We showed him the photographs we took when we accepted the apartment, the photographs of its condition after we cleaned it up, and the photographs we took when we left the apartment. We also provided him with the documents we received when we acquired the apartment, the list of defects the inspector found during his inspection, and the documents that the manager gave us at the meeting she convened.
"Harold," Frank said, "this manager was not going to lease the apartment to them because she doesn't believe in single people cohabiting. She refused to honor their approved application for an apartment. Mary and I used our contacts to get them in and were with them when they picked up the apartment keys. We were helping them move in, so we were there when they first went into the apartment. It was trashed. I suggested they take photos to document the condition. As you know, in my business I sometimes get involved in eviction actions. I think there is something fishy with this entire scenario, especially the eviction notice and the manner in which their eviction was handled."
"Give me a few minutes to look over these documents, Frank."
Harold glanced over the apartment lease, looked at all the photos, and then studied the eviction notice.
"Jim, I need to go over these documents more thoroughly, but based on a quick review, it appears that you and Cathy have a supportable case against the college. The manner of your eviction violated the state laws. The eviction papers she gave you are not valid since they were not issued by the court. Furthermore, a Deputy County Sheriff serves the eviction notice, not the apartment manager."
"That's good. Where do we go from here Harold?"
"To start with, we need to do some paperwork so my firm and I can represent you. I will have my associates help you to prepare statements as to the events you discussed with me. We will review the information you provided to us, prepare the preliminary lawsuit papers, and file them in court. At that time we will ask for a court order requiring the college to provide us with copies of all paperwork that document the condition, repairs, etc., of the apartment for the past seven years. We will also get the names of the tenants that leased the apartment during that period. We can use the services of a detective agency to look into Miss Johnson's past and to interview the apartment's prior tenants and some of the current tenants."
Harold and his associates helped Frank, Mary, and me to prepare our statements. Our statements dealt with the condition of the apartment at the time we moved in, and what we had done to improve its condition after we accepted the apartment. It also addressed all interaction we had with the Student-Housing Department and its personnel.
During the next several days, Harold prepared the necessary paperwork, filed our lawsuit with the local court, and obtained a court order for the college to provide us with copies of the information we needed. During all of this chaos, Cathy and I continued to attend classes.
The day after the college was served with the lawsuit, the Dean of Students requested that we appear in his office at 10:00 AM. When we arrived at his office, his secretary immediately escorted us into his office.
"Good morning Mr. Conrad, Miss Ambrose. The gentleman seated to your right is Mr. Thomas Conner. Mr. Conner is the college's lawyer. He has brought it to my attention that the two of you have filed a lawsuit against the college."
Cathy and I nodded to Mr. Conner to acknowledge his presence, and he nodded back. I started to explain our situation to the Dean, but Mr. Conner interrupted us.
"Excuse me Mr. Conrad. We cannot discuss the circumstances of the lawsuit without your councel being present. I want the two of you to understand that the lawsuit creates a conflict of interest between you and the college. I have advised the Dean to expel you from this college until such time as the lawsuit is settled."
The Dean stood and leaned over to hand Cathy and I the paperwork notifying us that we were expelled, and we had 24 hours to complete any activities related to us leaving the college property.
"Ah Dean, there is the matter of our tuition. How do we apply for reimbursement?"
The Dean said, "The College deems your expulsion to be for cause, so there will be no refund."
We had no business to conduct with the college offices, and we had all of our belongings with us. When we left the Dean's office, we went to Harold's office to inform him of what occurred. Once we finished venting our anger and frustration to Harold, we gave him the paperwork that the Dean gave us and prepared a statement of what happened in the Dean's office. Harold then proceeded to update the lawsuit to include damages for the college's action against us and filed an amendment to the existing lawsuit.
After leaving Harold's office, Cathy and I took a long walk to discuss our options. We then contacted our parents to give them the latest installment in the saga of our college careers. That evening we all got together at Frank and Mary's house to discuss the situation.
Cathy started out the meeting with, "As you know, Jim and I were expelled from college this morning. We have talked about it and decided that we will not be able to return to college until the lawsuit is settled. We also believe that the college will discriminate against us in the future, regardless of which way the lawsuit goes."
